RECENT REPRESENTATIVE MATTERS
· Successfully represented hospital in arbitration before a former Texas Supreme Court Justice, resulting in an award of $108 million against an insurance company for breach of its contractual obligation to pay for healthcare services: Rockdale Blackhawk, LLC d/b/a Little River Healthcare v. Blue Cross & Blue Shield of Texas, Adv. No. 20-06006-RBK (Bankr. W.D. Tex. June 6, 2020).
· Obtained complete defense jury verdict on behalf of officers and owners of a hospital system in $92 million lawsuit alleging breach of fiduciary duty and fraudulent transfers. Studensky v. Borgfeld, Case No. 21-MC-00028-ADA (W.D. Tex. 2023).
· Successfully represented major solar company as claimant in two-week arbitration regarding theft of trade secrets in San Francisco, California, with client receiving a multi-million dollar award (2021).
· Consulted on criminal case resulting in client’s acquittal after five week jury trial concerning allegations of $1.4 billion Medicare fraud. United States v. Durall, 3:20-cr-00086-TJC-JBT (M.D. Fla. Mar. 28, 2023).
· Obtained summary judgment on behalf of seven directors and officers of national laboratory company in $150+ million lawsuit alleging breach of fiduciary duty and fraudulent transfers. Willow Tree Consulting Group v. Grottenthaler, et al., Cause No. DC-21-01060, 192nd Judicial District Court, Dallas County, Texas, October 2022.
· Successfully represented hospital in $80+ million claim payment dispute with insurer in confidential arbitration resulting in favorable settlement (2024).
· Successfully represented management executives in $36 million fraudulent transfer and fraud claim by Bankruptcy Trustee, resolving matter with favorable settlement prior to filing of litigation (2023).
· Successfully represented hospital in $20+ million claim payment dispute with insurer resulting in favorable settlement: Knox County Hospital District v. Blue Cross and Blue Shield of Texas, Civil Action No. 7:19-cv-00095-0 (N.D. Tex.) (2022).
· Successfully represented laboratory executives in $50+ million claim payment dispute with insurer resulting in favorable settlement: Aetna v. Southwest Laboratories, et al, Cause No. 2018-31706 (152nd District Court, Harris County, Texas) (2022).
· Obtained Fifth Circuit reversal of lower court decision on attorneys’ fees resulting in $3.3 million fee award: In re Little River Healthcare Holdings, LLC, Case No. 21-50616 (5th Cir. May 18, 2022).
